Atspeed Racing Terms & Conditions

1) GENERAL
We are suppliers of mainly specially made, custom, one-off and non-standard items. This means that, by their very nature, the parts we supply may be subject to extended lead times, and may not be a straightforward DIY fit. In some cases, modifications or adaptations may be required to achieve an acceptable fit. We therefore recommend that parts we supply should be fitted by a suitably qualified person. We offer these services in addition to supplying goods.
We are committed to protecting your privacy. We only use the information we collect about you lawfully (in accordance with the Data Protection Act 1998).

These terms and conditions do not affect your statutory rights as a consumer. Transactions are governed by British Law and any dispute in transactions will be settled by British Law.

2) ORDERS
Orders placed via our online shop are mere offers to purchase and shall not be accepted or binding upon us until confirmed or acknowledged in writing by us by means of invoice or statement. The automatically produced order confirmation email is purely an acknowledgment that you have submitted your order and allows you to check that you have entered all information correctly.
We retain the right to cancel any order at any time. If payment has been made, we will provide a full refund immediately. All items should be considered out of stock unless confirmed as "in stock" via email prior to ordering. If your order is urgent we highly recommend contacting us directly before placing your order, and if need be we contact the manufacturer for you to request lead time on your behalf.
2a) ORDERS; SPECIALIST COMPONENTS / MADE TO ORDER
Orders for specially made parts or made to order items i.e flywheels, pistons  are authorisation for Atspeed Racing to process the order with the manufacturer on your behalf. These orders cannot be cancelled. If the customer through third party means cancels an order for a specially made part despite requesting its production, the customer will be liable for any and all costs accrued to the manufacturer and/or Atspeed Racing to present date for the customers order. It is the customers responsibility to make sure the part being manufactured is correct before ordering, specially made items are made specifically for the customer ordering them, and due to the manufacturers terms and conditions, are either non returnable, or subject to high/full restocking fees. Atspeed Racing where possible will keep a customer up to date with order status, or we can contact the manufacturer for an update on your behalf. It is clearly stated throughout the website that custom made parts may have extended lead time. 


3) PAYMENT
We will not despatch goods or put goods on back order until payment is received in full. Payment can be made by credit/debit card, Paypal, cheque or bank transfer. 

4) PRICES
We do our utmost to keep all prices and information on this web site up to date. However, occasionally information from our suppliers can change at short notice, so we must reserve the right to alter specifications and prices on the web site at short notice. In the rare event that the price of an item ordered through the on-line shop has changed we shall endeavour to hold to the price shown at the time of ordering. However, in cases where there is a substantial increase we shall contact you to agree a new price before accepting payment. If you do not wish to agree to the new price then we reserve the right to withdraw from the transaction. 
Some items in our online shop are listed at £0.00. This does not mean they are free but that a price was not available at the time of entering the data, usually because the item was still in development but due out soon. In such circumstances, contact us and we shall see if a price is now available. 
Very occasionally we can make a mistake in email or phone quotations. We reserve the right to correct these and will always inform you before proceeding with your order. We are not bound to the price quoted at time of ordering until you have received both the goods and an invoice.

5) DELIVERIES
When we quote delivery times it is in "working days". This means any day excluding Saturday, Sunday and public holidays. We shall inform you immediately if we are informed of any delay and will inform you of the new delivery date. 

6) SHORTAGES & DAMAGE IN TRANSIT
Once you or the person receiving the goods on your behalf has signed for them you have accepted that the goods are undamaged and that everything on the invoice/packing slip has been received. If goods are damaged and you inform us after signing for them we may not be able to make a claim from the couriers. Please inspect the goods as soon as possible after receipt and notify us immediately if there is a problem. If it is likely that you will not be the person signing for the goods (such as deliveries to a work address) it is your responsibility to ensure that the person signing knows what they are doing.

7) RETURNS
Unwanted goods for return must be notified to us in writing within 7 days of receipt. We reserve the right to refuse returns if notified outside this period. The cost of returning the goods safely to us is your responsibility. We may not be able to accept back non-faulty goods that have been supplied to your specific order or damaged during transit or fitting. Goods must be returned in a re-saleable condition. Some special order items correctly supplied may not be returnable depending on the manufacturer's policy on returns (this may include flywheels, camshafts or other low volume manufactured components)
Where goods are alleged to be defective, the purchaser agrees to return such goods for inspection and report (without us replacing the said goods prior to such inspection). The purchaser also accepts that it is reasonable to inform us of any interruption, defect or other failure prior to contacting independent third parties or incurring expense and, in addition, to allow us to remedy the defect, failure or interruption.

8) WARRANTIES & GUARANTEES
All guarantees for products are provided entirely by the manufacturers/UK importers and are subject to their terms and conditions. If you wish to pursue a warranty claim we shall act on your behalf and shall treat all claims as a matter of urgency. Some goods will need to be returned directly to the manufacturer, some will need to be returned to us. Please always contact our sales office first to confirm. Goods returned under warranty must be accompanied by a valid proof of purchase and must be returned carriage paid. If a manufacturer decides that a warranty claim is not valid then we will not be liable for any compensation. We will not accept any liability for any labour or associated costs involved in a warranty claim. Warranty does not cover consequential or personal losses under any circumstances.
Parts modified or adapted by the purchaser will not be warranted by the manufacturer nor shall Atspeed be liable for any failures resulting subsequent to modification as a result of such modification.

9) LIMITATIONS UPON LIABILITY
We aim to ensure that all information on our web site is correct. However, we cannot be responsible for the use of the information given.
Advice given by Atspeed staff on the telephone or by email is based entirely upon information given by the purchaser with no inspection undertaken. As such, all advice given is indicative only and should be checked by the purchaser prior to order. Where advice is given after visual inspection by Atspeed staff such advice shall amount to an opinion only. 
Goods are supplied only to correspond to the purpose for which goods of that kind are commonly supplied and not alternative uses to which they may be put. No liability for failure will be accepted by Atspeed for such alternative use, amendment or modification.
We always do our best to deliver goods within the timescale quoted at the time of ordering but sometimes there can be a delay which is outside our control. As such, any dates we specify for the delivery of goods are approximate only and we shall not be liable for any losses, costs, damages, charges or expenses caused by any delay for delivery of the goods. (We strongly recommend that you do not make arrangements to have parts fitted until they have arrived. We will not be held responsible for any charges incurred if such arrangements have to be cancelled due to a delay in delivery.)
All goods are subject to availability. If we do not supply the goods for any reason your credit card will be refunded the full amount. Atspeed will not be responsible for compensating you for any other losses which you may suffer if we do not supply the goods.
Goods may not be compatible with vehicles which have been modified, adapted or altered. Where goods ordered by the Purchaser are not compatible by reason of modification, adaptation or alteration, we may accept such goods back into stock entirely at our discretion and will either issue a refund or credit to the purchaser except where goods are specifically ordered for the purchaser where no such refund or credit will operate.
Under no circumstances will Atspeed be held liable for any fitting charges incurred by the purchaser. It is the purchaser's responsibility to ensure he has the correct parts prior to fitting. This can be as simple as comparing shape and size of the new items with the parts to be removed from the car. In the rare event of an item being defective we shall act on the customer's behalf to obtain compensation for fitting charges from the manufacturer/UK importer. If the manufacturer/importer refuses compensation then we shall not be held liable.
No liability is accepted by Atspeed where purchasers attempt to modify or install components where it is known or ought reasonably to be known to the purchaser that the part is incorrectly supplied or otherwise not in accordance with the order.

10) RETURNS
All returns of goods must adhere/agree to the following 
Goods MUST be in original packaging 
Goods MUST be in resaleable as new condition 
Atspeed Racing are not responsible for labour and or shipping/postal costs incurred on any warranty claim. 
Limited to replacement only. 
Liability and all other costs are to be met by the claimer. 
No return of goods after 30 days from date of receipt of goods. 
ALL returns will have a 15% restocking fee applied unless agreed prior to return. 
No return on specially manufactured, modified or procured/bought in goods. 
Goods that arrive back with Atspeed Racing for whatever reason without authorisation (INCLUDING Failed Deliveries that arrive back with us )will either:- 1. If Less than 30 days After checking with you first (See below for none contact) Be refunded 85% of purchase price (excl carriage) ie restocking fee of 15%. 2. If more than 30 days then you will be contacted and asked for a time you are going to be in to have the goods redelivered AND you will be billed the carriage charge again. 3. Finally if we cannot contact you by any reasonably means, eg email, phone, post, or fax within 6 months of Atspeed receiving back the goods then we assume you do not want them and we will dispose of the goods as we see fit with NO REFUND EITHER This also applies to surcharge money held until you return the item(s) ie If you don't return within 6 months then NO REFUND. The responsibility is yours to return the item you will not be reminded by us. 

11) PRIVACY POLICY
We are committed to protecting your privacy. We only use the information we collect about you lawfully (in accordance with the Data Protection Act 1998). 
We collect information from you when you place an order with us and from any emails we receive.
